Atomic Falls ("we," "us," "the platform") is a design-to-site builder: you describe or sketch a site, our tools generate a working website (and, for the mobile builder, a companion app) from that design, and you can then edit, publish, and host it through your account. These Terms govern your use of the platform, its dashboard, its APIs, and any site or app you create with it.
You need an account to create or manage sites. You're responsible for the accuracy of the information you give us, for keeping your login credentials confidential, and for activity that happens under your account. Tell us right away if you believe your account has been compromised. Accounts created during a limited invite-only beta may be subject to additional usage limits or early-access terms, which we'll disclose at signup.
You agree not to use the platform to:
We may suspend or terminate accounts that violate these terms, with notice where practical. Deliberate abuse (security attacks, spam, illegal content) may be suspended immediately.
You own what you put in: your mockups, copy, uploaded images, and any brand assets you provide. You also own the sites and apps our tools generate for you — the output belongs to you, not to us, and you're free to export it, self-host it, or take it elsewhere. We claim no ownership over your content or your generated output. You're responsible for having the rights to anything you upload or ask us to generate from (images, fonts, trademarks, and so on).
When you choose to generate using your own hardware (a local model running on your device) or your own API key for a third-party model provider, that generation call happens directly between your device/key and the model, not through a shared platform-hosted model. In that mode, your mockups and design prompts are not seen by us or by a third-party model provider we operate — only by the provider you've chosen to send them to yourself. If you instead use a platform-hosted model, the relevant prompt content and image data are sent to that model provider as part of generating your site, same as any AI-website builder that runs on hosted infrastructure.
Paid plans are billed in advance on a recurring basis through our payment processor. You can cancel at any time; cancellation takes effect at the end of the current billing period. We don't store your raw payment card number — that's handled entirely by our payment processor.
We aim for reliable uptime but don't guarantee the platform will be available without interruption. We may perform maintenance, and we may change or discontinue features with reasonable notice where practical.
The platform is provided "as is." To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither party will be liable for indirect, incidental, or consequential damages arising from use of the platform.
We may update these terms as the product evolves. If we make a material change, we'll update the effective date above and, for significant changes, notify accounts by email. Continued use of the platform after a change takes effect means you accept the updated terms.
These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles.
